Prompt Selling Policy – PromptOf

PromptOf (“we,” “our,” or “us”) operates https://promptof.com (the “Platform”) as a marketplace where users may buy and sell AI-generated or user-created prompts (“Prompts”). This Prompt Selling Policy (“Policy”) sets forth the rules, rights, and obligations for all users (“you” or “user”) engaged in selling Prompts on the Platform.

1. Eligibility to Sell Prompts

1.1 Users must be at least 18 years of age and have legal capacity to enter into binding agreements.
1.2 Users must complete account registration and provide accurate, complete, and verifiable information.
1.3 Users intending to sell Prompts must complete KYC verification before initiating any sale or withdrawal of funds.

2. Listing Prompts

2.1 Sellers are responsible for uploading Prompts that:

  • Are lawful, safe, and do not infringe any intellectual property rights

  • Are original or properly licensed for sale

  • Do not contain offensive, harmful, or malicious content

2.2 Sellers must provide accurate descriptions, metadata, and pricing for their Prompts.
2.3 PromptOf reserves the right to remove or reject any Prompt that violates these guidelines or applicable laws.

3. Ownership and Intellectual Property

3.1 Sellers retain ownership of their Prompts but grant PromptOf a non-exclusive, worldwide, royalty-free license to:

  • Display Prompts on the Platform

  • Facilitate transactions

  • Promote Prompts to potential buyers

3.2 Sellers represent and warrant that:

  • They have full rights to sell the Prompt

  • The Prompt does not infringe third-party intellectual property rights

  • They will indemnify PromptOf against any claims or losses arising from infringement or unauthorized content

4. Pricing and Payments

4.1 Sellers may set the sale price for their Prompts on the Platform.
4.2 PromptOf may deduct a commission fee as specified on the Platform before disbursing proceeds.
4.3 Payments are processed through approved third-party payment gateways (Paytm, Razorpay, PayPal, etc.). PromptOf is not responsible for delays, errors, or technical issues of payment providers.
4.4 Sellers are responsible for all taxes, duties, or government charges related to their sales.

5. KYC and Verification

5.1 Sellers must provide valid government-issued identification, bank account details, and any additional documentation requested by PromptOf.
5.2 Non-compliance with KYC requirements may result in suspension of selling privileges or withholding of funds.
5.3 KYC data is stored securely and shared only when legally required or with authorized third-party service providers.

6. Prohibited Sales

Sellers shall not list Prompts that:

Copied or AI generated prompts

  • Contain illegal, harmful, or offensive content

  • Violate intellectual property rights

  • Promote fraud, scams, or malicious activity

  • Are designed to manipulate or exploit buyers unfairly

PromptOf reserves the right to remove prohibited listings without notice.

7. Refunds, Disputes, and Cancellations

8. Liability

8.1 PromptOf acts solely as a marketplace facilitator and does not produce or modify the Prompts.
8.2 Sellers acknowledge that buyers rely on the provided descriptions and accept that PromptOf is not liable for buyer dissatisfaction, loss, or misuse of Prompts.
8.3 Sellers shall indemnify PromptOf against all claims, liabilities, and expenses arising from their Prompts or breach of this Policy.

9. Data Protection

9.1 Personal data of sellers will be collected, used, and processed in accordance with the PromptOf Privacy Policy.
9.2 Sellers must maintain confidentiality of buyer information obtained during transactions and shall not misuse or disclose it without consent.

10. Termination of Selling Privileges

10.1 PromptOf may suspend or terminate selling accounts at its discretion for:

  • Breach of this Policy

  • Fraudulent or illegal activity

  • Non-compliance with KYC or payment requirements
    10.2 Upon termination, pending sales may be canceled, and access to seller funds may be withheld until compliance verification.

11. Modifications

PromptOf reserves the right to update or amend this Policy at any time. Changes will be posted on the Platform with the revised Last Updated date. Continued use of the Platform constitutes acceptance of the updated Policy.
